When applying to the English Courts, for example to obtain evidence in support of overseas litigation or arbitration, it is important to have English legal advice from the time of the application in front of the overseas court or arbitration panel concerned. The procedures for securing evidence and the limitations on evidence that can be secured vary enormously between jurisdictions. If applications are not formulated and proceeded with correctly in compliance with English law requirements, an overseas order may be successfully opposed when trying to implement it in the English courts. Given the "loser pays" approach of the English courts to the parties' legal fees, getting it wrong can not only fail to obtain the required evidence but may also have the expensive result of having to pay all parties' legal fees. Carter Perry Bailey is able to assist overseas law firms in relation to applications in the English courts for orders in support of overseas litigation and arbitration, as well as with service and enforcement of overseas process within this jurisdiction. Our Court Clerk, Marcus Giraudel, has a wealth of experience of working with the Court system including as a Judge's Clerk and with major London law firms during which time he has developed excellent working relationships at the Royal Courts of Justice.
