Reinsurance

A major part of the practices of all of Carter Perry Bailey's lawyers is in the reinsurance market. Recently, Carter Perry Bailey successfully represented AGF Insurance in its successful appeal to the House of Lords in one of the most important cases to the reinsurance market in many years – Lexington v AGF Insurance.

Reinsurance is an area where specialist expertise and the ability to master complex factual and legal relationships, often involving more than one system of law, are essential. Lawyers advising on reinsurance issues need to understand the business of reinsurance and the practices of the market. Each of our lawyers has a depth of experience in this market going back up to 25 years. Carter Perry Bailey offer a full range of reinsurance services including the drafting of contractual documents and policies, the handling of insurance and reinsurance disputes, agency and broking issues, transfers of business, run-off and finality solutions. Our lawyers are experienced in handling complex international reinsurance litigation and arbitration (both ad hoc and institutional) as well as reinsurance recoveries and commutations. They have acted in FSMA transfers of business and schemes or arrangement, both for scheme participants and for third parties either making submissions at approval hearings or submitting scheme claims. Stephen Carter and William Sturge are recognised by Chambers Directory as leaders in the field of reinsurance. Stephen has provided expert witness evidence in overseas litigation on English reinsurance law. He has also worked in-house at a leading run-off management company and is a director of a reinsurance company in run-off.
